3. The Government shall have power at any time to terminate th
Agreement upon giving to the said John Thomas Hornsby Sample Three months, notice, in writing or paying him a sum equal to Three months salary in hew of such notice.
A fee First Class passage shall be provided for the said John Thouss Hornoby Sample and on the satisfactory termination of his Three years engagement back to England and if this Agreement phall be terminated by the Severnment under the preceding Clause the said Government shall also provide the said John Thomas Hornsby Sample with a free First Class passage to England provided the conduct of the said John Thomas Hornsby Sample shall have been satisfactory, during his service and shall also pay to him half salary during the time occupied on the voyage home and in the event of the said John Thomas Hornoly Sample being compelled at any time during the period of Three years to resign his appointment owing to illness not caused by any impropriety of conduct on his part, and producing a Certificate from the Colonial Surgeon to that effect he shall be provided with a free First Class passage to England.
5 . If the said John Thomas Hornsby Sample shall at any kme neglect or refuse or from any cause bother than illness, not caused by his own empropriety of conduct) become unable to perform or comply with all or any of the Arkeles of this Agreement or all or any of the duties, required of him, or all or any of the orders or directions of the Government, or shall, in any manner, misconduct himself, it shall be lowful for the Government to declare the employment of the said John Thana Hornsby Sample, under this Agreement to be at an end and thereupon his engagement shall cause and this Agreement shall not have any further prospective operation or force and all rights, and benefits reserved to the said John Thomas Hornsby Sumpt shall cease; but without prejudice to the enforcement of existing claim 4.
